Terms of Service

1. Acceptance of Terms

By accessing or using the Wicked Smart HQ platform (the “Service”), including our website at wickedsmarthq.com and app.wickedsmarthq.com, you (“you” or “User”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Wicked Smart HQ (“we,” “us,” or “our”). We may update these Terms from time to time in accordance with Section 13 below.

2. Description of Service

Wicked Smart HQ is a software-as-a-service (SaaS) household management platform that helps families and households organize their daily lives. Features include shared calendars, task management, bill tracking, shopping lists, meal planning, recipes, and more.

Each household may include up to eight (8) members. The Service is provided via web applications hosted at wickedsmarthq.com and app.wickedsmarthq.com. Feature availability may vary depending on your subscription plan. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Accounts and Registration

To use the Service, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least eighteen (18) years of age to create a household on Wicked Smart HQ. Minor household members (“kid profiles”) may only be added and managed by a parent or legal guardian who holds an account on the platform. Kid profiles have restricted permissions and do not have independent login credentials.

You agree to provide accurate, current, and complete information during registration and to update such information as needed. We reserve the right to suspend or terminate accounts that contain false or misleading information.

4. Subscription and Billing

Wicked Smart HQ offers a thirty (30) day free trial for new households. After the trial period, continued access to the Service requires a paid subscription.

  • Monthly plan: $7.99 per month
  • Annual plan: $79.90 per year (equivalent to $6.66 per month)
  • Additional members: $1.00 per month for each household member beyond the base plan allowance

All subscriptions auto-renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you will retain access to the Service until that date. We do not offer prorated refunds for partial billing periods.

Prices are subject to change with at least thirty (30) days' notice. Payment is processed securely through Stripe. We do not store your credit card information on our servers.

5. Content Ownership

You retain full ownership of all content you create, upload, or store on the Service, including but not limited to calendar events, tasks, recipes, shopping lists, meal plans, bills, and notes (“User Content”).

By using the Service, you grant Wicked Smart HQ a limited, non-exclusive, royalty-free license to store, display, and process your User Content solely for the purpose of providing and improving the Service. For recipes or other content you choose to share publicly through our community features, you grant an additional license allowing other users to view, copy, and use that content within the platform. Original attribution to you as the creator will be preserved on all shared content.

You may export or delete your User Content at any time through the Service or by contacting us.

6. Community Content

Wicked Smart HQ offers a community library where users may share recipes publicly with other users of the platform. When you share a recipe to the community library, you acknowledge the following:

  • Other users may view, copy, and add your shared recipes to their own household collections.
  • Your name or display name will be attributed as the original creator of the recipe.
  • You may remove your recipe from the community library at any time; however, copies already saved by other users will remain in their collections.

You represent and warrant that any content you share to the community library is your own original work or that you have the right to share it. Community content must not be offensive, hateful, sexually explicit, defamatory, or misleading. Content that infringes on the intellectual property rights of others is strictly prohibited and subject to removal under our DMCA Policy.

7. Acceptable Use

You agree not to use the Service to:

  • Harass, abuse, threaten, or intimidate other users or any third party.
  • Upload, post, or transmit spam, unsolicited messages, or promotional material.
  • Upload, post, or transmit any content that is unlawful, harmful, fraudulent, or otherwise objectionable.
  • Scrape, crawl, or use automated means to access the Service without our prior written consent.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
  • Impersonate any person or entity, or falsely claim an affiliation with any person or entity.
  • Interfere with or disrupt the integrity or performance of the Service or the data contained therein.
  • Attempt to gain unauthorized access to the Service, other user accounts, or any related systems or networks.

Violation of this Acceptable Use policy may result in immediate suspension or termination of your account.

8. AI Features

Wicked Smart HQ incorporates artificial intelligence features, including but not limited to logo generation and recipe assistance. These features are powered by third-party AI providers, specifically fal.ai for image generation and Anthropic for text-based AI capabilities.

AI-generated content is provided “as is” without any warranty of accuracy, completeness, or fitness for a particular purpose. You are solely responsible for reviewing, editing, and using any AI-generated content. AI-generated images and text should not be relied upon for nutritional, medical, legal, or safety-critical decisions.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the data practices described in our Privacy Policy.

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users or the Service, or is otherwise objectionable.

You may delete your account at any time through your account settings. Upon account deletion, your User Content will be removed in accordance with our Privacy Policy. Certain data may be retained as required by law or for legitimate business purposes such as fraud prevention.

11. Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WICKED SMART HQ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE TOTAL AMOUNT OF SUBSCRIPTION FEES PAID BY YOU TO WICKED SMART HQ DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules. Arbitration shall take place in the United States, and the language of arbitration shall be English.

YOU AND WICKED SMART HQ AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

You may opt out of this arbitration agreement by sending written notice to hello@wickedsmarthq.com within thirty (30) days of first accepting these Terms. Your opt-out notice must include your full name, account email address, and a clear statement that you decline the arbitration agreement.

13. Modifications to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you at least thirty (30) days in advance by sending an email to the address associated with your account. The updated Terms will also be posted on this page with a revised effective date.

Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.
